What the Site is, and what it is not

The Site publishes general information about packing and planning for a hospital or birth center stay, such as a birth, surgery, or an overnight stay. We are not a hospital, birth center, clinic, health care provider, pharmacy, or insurer, and we are not medical or legal advisers. We do not sell any product. The Site does not give medical advice, and it does not say what any hospital provides, allows, or requires.

Important health and pregnancy notice

Pregnancy, labor, birth, recovery, surgery, and any hospital stay are medical matters. Content on the Site is not medical advice and is not a substitute for advice from your doctor, midwife, surgeon, or other clinician, or for the instructions of your hospital or birth center. Always ask your clinician about your health and your care, and ask your hospital or birth center what to bring and what to expect. If you think you have a medical emergency, call 911.

General information only; no medical, legal, or professional advice

Content on the Site is for general information. It is not medical, nursing, legal, insurance, or other professional advice. Mentions of documents such as advance directives are general information, not legal advice. We do not say that any product, item, or practice is safe, effective, necessary, or right for you or your baby.

Hospitals and birth centers set their own rules

Hospitals and birth centers decide what they provide, what they allow, and what they ask you to bring. Their rules differ and can change. Nothing on the Site describes the policy of any hospital or birth center. Check with yours.

Medicines, supplements, and health products

The Site does not recommend or make claims about any medicine, supplement, or health product. Ask your clinician and your hospital how to handle any medicines you take.

Car seats and the trip home

Where the Site mentions car seats, it does so as the National Highway Traffic Safety Administration (NHTSA) or the American Academy of Pediatrics describes them, for general information only. We do not test, rate, or recommend any car seat, and we do not give installation instructions. Follow the car seat maker's instructions and your vehicle owner's manual.

We do not sell products

We do not make, sell, or ship any product. Any purchase is between you and the retailer, and the maker's labels, instructions, and warnings control over anything on the Site.

"Hospital Bag HQ" is the name of the Site. It is not a hospital, a medical provider, or a store, and it is not affiliated with any hospital or birth center.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PURCHASE FROM A THIRD PARTY, OR ANY HEALTH, PREGNANCY, BIRTH, OR CAR SEAT DECISION, OR THE CHOICE OR USE OF ANY PRODUCT. Indemnification

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.

Assignment and change of operator

We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.

Miscellaneous

These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
